BUYERS:
All potential buyers must register prior to bidding and receive a buyer number to be used during the bidding process.
By registering as a buyer or bidding in the auction, you are agreeing to the terms and conditions of the auction.
BIDDING:
Each lot will be sold to the highest bidder as determined by the auctioneer.
RESERVES:
This is an auction “With Reserve”. The seller may buy back his/her lot (himself/herself or by a designated representative)
which will be subject to the appropriate commission rate at the last live bid.
Lots offered for sale for which no bids are received will be passed out.
BIDDING DISPUTES:
The auctioneer in charge will settle any dispute as to bids and his decision on such matters shall be final.
ANNOUNCEMENTS:
Announcements from the Auction Block shall take precedence over printed material and/or catalog.
GUARANTEE:
Representations and guarantees are strictly between the individual consignor and the buyer. Information presented
or announced is furnished solely by Consignors and TDA makes no representations, warranties or guarantees (written or implied)
as to information/pictures presented or suitability for use, condition, production capability, marketability or purpose of items
presented for sale.
POSSESSION:
Ownership transfers to Buyer at the fall of the Gavel. Seller will maintain possession, and keep in good condition, live
animals and merchandise not located at the sale and available for immediate pick-up, until receiving full payment from the buyer.
ASSUMPTION OF RISK:
All persons who attend and participate in the auction do so at their own risk and neither TDA nor its
employees assume liability for any accidents or miscommunications that may occur.
CONTRACT:
Once the auctioneer announces “SOLD”, a contract is created that is solely between the Consignor and Buyer. A
contractual invoice will be submitted to the buyer for his/her immediate acknowledgement by a designated runner. The auction
relationship between TDA, the Consignor, and the Buyer is that of an independent contractor and TDA expressly disclaims any
agency relationship between it and the Consignor, as well as it and the buyer.
INTERNET BIDDING:
Internet On-Line Bidding is provided as a convenience and as an alternative method to live bidding.
Prospective internet buyers MUST register with the internet simulcast provider (DV Auction) prior to bidding. On-line Bidders
agree and understand that the only way to assure acceptance of their bids shall be to be present at the sale site. TDA nor seller
shall be responsible in the event of loss of connection and/or technical difficulties that may result in Bidder’s inability to bid on-line.
Additionally, buyer acknowledges internet broadcasts for TDA auctions are best viewed using high-speed internet access (i.e.: DSL,
T-1, Cable, Satellite and Wireless). Internet viewing below 400kbps connection is NOT recommended.
DELIVERY:
Delivery or pick-up and associated costs/charges shall be negotiated between Consignor and Buyer. TDA shall have no
duty or liability related to transfer of possession.
PAYMENT:
Payment is due immediately upon close of the auction. Payment may be made by cash, personal or company check, or
credit card. Buyers are required to pay 50% down on deer (unless stated or announced that Buyer may pay 25% or 15% down day
of sale) and 100% on semen, of the purchase price on day of sale at the auction. No credit card convenience fee will be charged,
however, any On-Site auction purchase not paid at the close of the auction or On-Line auction purchase not paid by close of the
next business day following the sale will be charged an additional 2.5% admin fee to offset costs of billing. Buyers agree to a
1.5% per month finance charge on all unpaid balances due to TDA over 30 days. Unless otherwise announced or agreed, buyer is
required to pay any remaining balance to Consignor at the time of possession transfer.

NEITHER THE AUCTION MANAGEMENT TEAM NOR TEXAS DEER ASSOCIATION MAKE ANY GUARANTEES,
EXPRESSED OR IMPLIED, AND ASSUME NO LIABILITY AS TO THE ITEMS REPRESENTED IN THIS AUCTION.
POTENTIAL BUYERS ARE URGED TO MAKE THEIR OWN INVESTIGATION AND ARE FREE TO MAKE INQUIRIES
PRIOR TO OR AT THE TIME OF THE AUCTION.
