Bidding:
each lot will be sold to the highest bidder as determined by the auctioneer.
if any bidding disputes arise, the auctioneer in charge will settle any dispute as to
bids and his decision on such matters shall be final.
Announcements:
Any changes in information in the auction catalog printed at
the request of consignor will be announced from the auction stand as provided by
consignor and such announcements shall take precedence over the catalog. All
semen lots with multiple straws in a lot will be sold by the straw. {For example: 5
straws x auction price = total purchase price}
Guarantees:
representations and guarantees are strictly between the individual
consignor and the buyer. TDA makes no representations or guarantees regarding
any of the lots or information contained the description of the lot, which is furnished
solely byconsignor. TexasDeer Associationassumes no responsibility for trophy size
or lack thereof, nor does it accept any responsibility for craftsmanship or defects of
any nature in products offered. Announcements from the “block” supersede printed
material.
Assumption of Risk:
All persons who attend and participate in the auction do so at
their own risk. TDA nor its employees and/or contractors nor the JWmarriot assume
any liability for any accidents or miscommunications that may occur.
Contract:
When the auctioneer announces “solD”, a contract between Texas Deer
Association and Buyer is created and a contractual invoice will be submitted to the
buyer for his/her immediate acknowledgement by a designated runner.
Delivery:
items in the auction that are “on site” must be removed by purchaser
upon departing the convention unless otherwise noted. Delivery of “off site” items
(including deer, semen, trips, etc.) must be arranged between buyer and seller.
Payment:
items in this auction are donations to Texas Deer Association. payment
for all purchasesmust bemade by the close of the auction and only upon completion
of payment will the buyer be allowed to remove items, unless otherwise arranged
with the auction management or TDA staff.
