15. Buyers and spectators are cautioned to be careful while on the grounds, particularly while horses are being shown or sold in the
sale ring. All persons attending the sale do so at their own risk. According to the laws of the State of Nebraska, neither the owners
nor any other person connected with this sale assume any liability, legal or otherwise, for accidents to persons or property,
before, during, or after the sale.
16. Upon receiving payment for a horse, the cashier will issue an order to obtain delivery. Buyers are cautioned not to lose their
receipts. Buyers must make arrangements for care of stock until it can be removed. Buyer will need to use the “pink slip” to
be released to load. Do not remove hip numbers from horses once they are applied. Buyer releases will be checked against hip
numbers and no horse will be released without a legible hip number.
17. Driver’s license will be required to obtain a buyer’s number. Payment terms for this sale are cash. Payment in full must be made
to the cashier immediately after the sale. All payments shall be U.S. Currency. Method of payment shall be Cash, Cashier’s Check,
Traveler’s Checks, or approved bank check which has been verified and approved in advance by cashier and/or officers of Pitzer
Ranch. All payments must be made to Pitzer Ranch. Any payment made by the buyer to the consignor or any other party will not
be regarded as valid or entitle the buyer to delivery of the animal.
No Re-Deposits: Anyone issuing us an insufficient fund check for a horse will run the risk of having their name printed in our
mailing of 115,000 catalogs and flyers. The size of a NSF horse payment check classifies as a felony and it will be turned over to
the District Attorney for immediate prosecution. All past buyers who have passed a “returned check” to the Pitzer Ranch will be
required to pre-pay for their purchases or pay in cash.
18. All registration papers will be withheld until funds clear the bank. 14 days from the date of the sale the registration papers, along
with transfer certificates, will be mailed directly to AQHA for transfer of ownership to the new buyer. Checks for payment will be
mailed to the sellers on that same date. Disputes and returns between buyer and seller need to be completed by that date.
19. Buyers will pay the AQHA $20.00 transfer fee. All buyers will be charged the current rate of sales tax on any purchase, unless a
tax number is given and the proper form is filled out at the office. You will be asked for your current AQHA membership number.
Persons not having a current membership can either purchase one directly from AQHA or buy one at the time of payment for
purchases.
20. Any horse not consigned to the sale and found on the grounds will be assessed a $175 fee and will go through the auction at the
end of the sale. A release for this horse will not be issued until these terms are met. No horse will be let out the gate without a hip
number and release issued through the office.
