PITZER RANCH SALE GUIDELINES
Please read and familiarize yourself with these 2 pages
Pitzer Ranch, its associates and the auctioneers’ function is to bring the buyer and seller together.
All responsibilities and guarantees lie between the buyer and seller.
All buyers must pre-register in the sale office.
Bank name, Address and Drivers License will be required to obtain a Buyer’s Number.
EXAMINE HORSES PRIOR TO PURCHASING
(be sure to attend the previews, look your choices over, and ask any questions you may have)
 1. Persons planning to purchase horses in this sale for the first time should present letters of credit from their banks if personal
checks are used in payment. Anyone with account problems with Pitzer Ranch in the past will be required to pay for their horses
with cash.
 2. There is no implied warranty made by auctioneer or sale company as to the merchantability or fitness for a particular purpose of
any animal in the sale.
 3. The highest bidder is to be the buyer. If any dispute arises between or among two or more bidders, sole authority to settle the
dispute as he sees fit is reserved by the auctioneer and the decisions shall be final. Seller reserves the right to waive the sale of
his horse before it leaves the ring. The auctioneer reserves the right to reject any or all bids.
 4. The Sales Management is not responsible for the integrity of any specific bid and the seller understands and assumes all
responsibility for any bid that is made and not thereafter honored. In the event any bid is not honored, the seller agrees not to
hold the Sales Management responsible and agrees not to sue the Sales Management therefore.
 5. All horses are offered for sale according to the laws of the State of Nebraska and the right to bid is reserved for all sellers at the
sale unless otherwise announced.
 6. Effort has been made to insure correctness of this catalog and, in most cases, information quoted concerning the horses is taken
from the official AQHA records. However, employees and auctioneers will not assume responsibility for errors or omissions, but
appreciate having them called to their attention. Announcements in the ring take precedence over printed information. Pay close
attention to the announcements.
 7. The seller is the responsible party for all representations or warranties, expressed or implied concerning the condition of any horse
and buyers should satisfy themselves concerning the condition of any horse they purchase. Except as otherwise announced by
the auctioneer at the time of sale, the consignor of each animal represents and warrants to the buyer and Pitzer Ranch Sales to
include but not limited to the following: 1. Title of the animal, free from all adverse claims to ownership, use or possession. 2. The
animal is sound of eyes and wind. 3. The animal is not a cribber or wind sucker. 4. The animal does not or has not been nerved,
have navicular disease, have ringbone, been foundered or any other pre-existing condition. 5. The sex or condition as a gelding or
ridgeling is as described in the sale catalog or announced at the time of sale. 6. Any animal which, at the time of sale is described
as a stud or colt and does not at such time have two testes descended to the scrotum must be announced. Warranty with respect
to descended testes does not apply to any horse sold prior to Jan. 1 of his yearling year. 7. The horse does not possess the defect
commonly known as parrot mouth. If any conditions are announced, the consignor is held harmless for the condition.
 8. All guarantees are made by the owner. Make sure to call ahead with questions, take advantage of the previews and pre-inspect
horses prior to purchasing as title passes as horse leaves the ring. Right of recourse must be directly to the owner of the horse.
 9. All horses have been Coggins tested and found negative within six months of the sale date unless announced differently. Coggins
papers given to buyers after horses are paid for.
10. In the event a dispute should arise as to a particular defect which should have been, but was not announced as described
above, the buyer has the right to have a veterinarian examine the horse he has purchased to determine if the horse suffers from
the defect. This examination is to be made and Pitzer Ranch is to be notified before the checks are mailed. If the purchaser’s
veterinarian determines the horse to have alleged defect, the Sales Management, as agent, shall appoint a veterinarian of its
choice to determine if the horse has the defect(s) and if the defect was present at the time of sale. His or her decision will be
final. If Pitzer’s veterinarian determines that the defect was present at the time of the sale and it was not announced, the sale of
said horse shall be null and void and the consignor must pay entry fee and commission. If the horse is determined by the Sales
Management veterinarian not to have the alleged defect, the sale of said horse is valid and enforceable and purchaser assumes
all costs of examination, treatment, and sale purchase price. In settling disputes, the decision by Pitzer Ranch is final.
11. If the buyer rightfully rejects the animal in the manner stated in #10, the animal will be returned by the buyer to the consignor and
the full purchase price of the animal will be refunded.
12. The seller guarantees all mares were bred to stallions as indicated in the catalog. We believe them to be in foal, but are selling
them as is and without return privileges, unless otherwise specified.
13. Sale of a horse is completed by the auctioneer and title passes when the clerk enters buyer # and $ Sold Amount on the
Acknowledgment of Purchase contract. Title passes when this is completed. When a buyer settles in the sales office to clear
paperwork and receive loadout slips, make sure the name, address, phone and AQHA information is filled out exactly as
registration papers are to be transferred or office cannot be responsible for errors that may occur in transfer of ownership.
14. Title to and risk of loss passes to the buyer when the animal is knocked off as sold by the auctioneer. Immediately after the
horse is sold, it will be the sole risk and responsibility of the buyer. Effective from the time of purchase, the buyer assumes
responsibility for the maintenance and care of the animal. The buyer and sale attendees further agree to hold the consignor and
Pitzer Ranch harmless from all loss, cost and expense arising from illness, injury or death of such animal, or loss or damage to
property, and injury or death of persons, caused by themselves, their agents or employees, or by the animal, subsequent to the
time of purchase. No horse will leave until final settlement has been made.
