Handling Risk:
Each animal will be at Purchaser’s
risk as soon as sold, but loading assistance will be provided
after settlement has been made. Each animal will be fed, wa-
tered and cared for at Purchaser’s risk for a reasonable time to
allow for removal to Purchaser’s farm.
Breeding Guarantee:
This is a dispersion sale, and
all animals must sell with no further breeding guarantee, and
all females of breeding age that have been served by A.I. or
naturally for more than forty-five (45) days will be pregnancy
checked. A veterinary certificate of fertility and pregnancy
will be furnished to the Purchaser upon request.
Rights and Obligations:
In the event of default in
any part of the Terms and Conditions covering this sale by ei-
ther the Buyer, or the Seller, it shall be the responsibility of
the Buyer, or the Seller, to instigate any action necessary to
bring about a fair settlement of any claims arising from this
sale and to be responsible for any and all cost involved
therein. The sale manager assumes no responsibility, legal or
otherwise, for the failure of either Seller or Buyer to fulfill his
obligations.
All persons who attend this sale do so at their own risk.
Neither the owners, the sale manager, or any other persons
connected with the sale, assumes any liability, legal or other-
wise.
The Greenbrier Cattle Co. guarantees all information contained in
the sale catalog as modified by announcements and sale supplements .
Since this is a dispersion and we will not be in the registered Limousin
business after sale day, we make no other guarantees or warranties ex-
pressed or implied.
