terms & conditions of the sale
TPW currently restricts the shipment of deer into Texas and all buyers and sellers must comply with TPW current
regulations. The laws and regulations in effect at the time of the sale will prevail.
Buyers: All potential buyers must register prior to bidding and receive a buyer number to be used during the bidding
process. By registering as a buyer or bidding in the auction, you are agreeing to the terms and conditions of the
auction. In the event a person wishes to buy and hasn’t been registered and received a buyer number, a runner will be sent
to sign that person up on the spot.
Bidding: Each lot will be sold to the highest bidder as determined by the auctioneer.
Bidding Disputes: The auctioneer in charge will settle any dispute as to bids, and his decision on such matters shall be
final.
Announcements: Any changes in information in the auction catalog printed at the request of consignor will be announced
from the auction stand as provided by consignor and such announcements shall take precedence over the catalog. All semen
lots with multiple straws in a lot will be sold by the straw. {For Example: 5 straws x auction price = total purchase price}
Guarantee: Representations and guarantees are strictly between the individual consignor and the buyer. TDA makes
no representations or guarantees regarding any of the lots or information contained the description of the lot, which is
furnished solely by Consignor.
Possession: Seller will maintain possession of his/her deer or semen sold at the auction until delivered or buyer picks up
the deer or semen and full payment is made.
Assumption of Risk: All persons who attend and participate in the auction do so at their own risk and TDA and Hicks
Whitetail Ranch and its employees assume no liability, for any accidents or miscommunications that may occur.
Contract: When the auctioneer announces “SOLD”, a contract between Consignor and Buyer is created and contractual
invoice will be submitted to the buyer for his/her immediate acknowledgement by a designated runner. The contract is
solely between the Consignor/seller and buyer. The relationship between TDA and consignor and buyer in relation to
the auction is that of an independent contractor and TDA expressly disclaims any agency relationship between it and
the consignor and it and the buyer. The seller is responsible for all transfer permits. The relationship between TDA and
auctioneer is that of an independent contractor, and TDA disclaims any agency relationship with auctioneer.
Delivery: Terms of Delivery of the deer or semen is solely between the buyer and seller.
Payment: Payment may be made by personal or company check or credit card. Buyers MUST pay immediately upon
close of the auction by paying 50% {deer} and 100% {semen} of the purchase price at the cashiers table at the
auction. Any auction purchase not paid at the close of the auction will be charged an additional 2.5%. Unless otherwise
announced or agreed, buyer is required to pay any remaining balance to Consignor at the time of delivery. SEMEN LOTS
must be paid in full at time of sale.

ITEMS REPRESENTED IN THIS AUCTION. POTENTIAL BUYERS ARE URGED TO MAKE THEIR OWN INVESTIGATION AND ARE
FREE TO MAKE INQUIRY PRIOR TO OR AT THE TIME OF THE AUCTION
