Except for those stated in the below terms and conditions, there
are no warranties, either expressed or implied, as to the mer-
chantability of fitness for a particular purpose with respect to the
cattle being sold at this auction.
The warranties and guarantees set forth in the “Terms and
Conditions” are in lieu of all other warranties either expressed or
implied, and the remedies provided therein shall be the sole and
exclusive remedy of the buyer, or any part through the buyer, for any
breach of warranty or guarantee therein provided, and all other obli-
gations or liabilities.
BIDDING:
Each animal will be sold to the highest bidder without reserve. The
auctioneer in charge will settle any disputes as to bids and his deci-
sion will be final.
TERMS:
All terms are cash or check. Settlement must be made to the clerk
at the conclusion of the auction.
PURCHASER’S RISK:
Each animal becomes the risk of the purchaser as soon as sold; but
will not be delivered until settlement has been made.
CERTIFICATE OF REGISTRY:
When full settlement has been made, a certificate of registration will
be furnished and transferred to the purchaser on those lots that are
registered. Give full name and address to secretary when making
payments so the Certificate of Registry will be transferred properly.
ANNOUNCEMENTS:
Announcements from the auction box will take precedence over the
printed matter in this catalog. All cattle will be sold by lot numbers
as announced by the auctioneer.
BREEDING GUARANTEE:
(A) Any female is considered a breeder if she is pregnant at the time
of sale and/or she has a calf at side.
(B) Safe in calf females have been examined by a competent veteri-
narian and are so guaranteed.
(C) Served females are believed to be in calf but are not so guaran-
teed.
(D) Pasture-bred females have been exposed but are not guaranteed to be
in calf.
(E) Open females have not been served and are so guaranteed.
HEALTH:
All animals are eligible for interstate shipment and have been test-
ed for Bang’s disease within thirty (30) days of the sale date. A
health certificate will be furnished on each animal.
OPTIONS AND PRIVILEGES:
(A) All information listed is believed to be accurate and precise as
compiled by a licensed and competent veterinarian and or ranch
personnel. Every effort has been made to insure the reproductive
soundness of each lot. Each lot is believed to be physically and
reproductively sound.
(B) The warranties and guarantees set forth in the “Terms and
Conditions” are in lieu of all other warranties either expressed or
implied, and the remedies provided therein shall be the sole and
exclusive remedy of the buyer.
RIGHTS AND OBLIGATIONS:
The above terms and conditions of sale constitute a contract
between buyers and sellers of each animal and shall be equally
binding upon both.
Animals resold following purchase in this sale shall constitute a sep-
arate transaction, and the rights and obligations of the two parties
connected thereto are not covered by the terms and conditions of
this sale.
All persons who attend the sale do so at their own risk and the own-
ers or any person connected with the management of the sale or
sale facility assume no liability, legal or otherwise, for any accidents
which may occur. Except for those stated in the below terms and
conditions, there are no warranties, either expressed or implied, as
to the merchantability or fitness for a particular purpose with respect
to the cattle being sold at this auction.
