Sale Terms & Conditions
TERMS: Terms of the sale are cash. Each animal will be sold to
the highest bidder. The auctioneer will settle any disputes as to bids.
Settlement must be made promptly day of sale.
PURCHASE: Each animal will be the purchaser’s risk as soon as
sold and can be moved only after settlement has been made. Animals
must be removed from the premises by noon on Sunday, March 4th.
HEALTH: Health papers will be furnished for each heifer. Out-
of-state buyers should be aware of any special requirements and/
or permits of their respective states and shall be responsible for the
same.
CONSIGNOR’S RESPONSIBILITY: The seller is the responsible
party for all representations made about the cattle. The management
of the sale assumes no liability, legal or otherwise, but will endeavor to
protect the interest of both the buyer and the seller.
CHANGES: Any changes from printed material will be announced
sale day. Announcements from the sale box take precedence over
anything printed in this catalog.
PAPERS: Registration papers will be transferred by sale personnel
at no cost to the buyer. Each buyer must give the clerk his proper
name and address for making transfer. All calves born after the sale
are to be registered by the purchaser, NO service AI certificates will
be furnished for bred heifers.
1. Breeding guarantee - all animal are guaranteed to be breeders
(with the exception of): (a) injury or disease occurring after the sale,
(b) gross negligence or willful misconduct on the part of the purchaser.
2. Safe in calf females - have been examined by a competent
veterinarian and are guaranteed.
3. Open females - have not been served and are guaranteed.
Options and Privileges of Return or Adjustment
1. All claims for adjustment or refund must be made in writing to
the consignor within six months of sale date.
2. In the event an animal is claimed to be a non-breeder, the
animal may be returned to the farm of the seller in good condition and
complying with health requirements of the seller state. The seller shall
be entitled to six months to prove the animal is a breeder. If the seller
is unable to prove the animal is a breeder, the seller shall replace the
animal with another of equal value or shall refund the full purchase
price.
3. If the female sold as “safe in calf” proves not to be in calf, the
seller shall be obligated to make a satisfactory adjustment on the
purchase price or refund the purchase price upon return of the animal
to the farm of the seller.
4. Cows with calves at sides are presumed to be breeders with no
further fertility guarantee.
5. Any expense incurred for transportation shall be the
responsibility of the purchaser, except that the seller shall be
responsible for transportation cost in excess of the distance between
the purchaser’s farm and the location of the sale.
