health requireMents - u.s. buyers:
Your local or state veteri-
narian should be able to update you concerning the health requirements for
sheep entering your state. All sheep sold must be in compliance with cur-
rent Federal Scrapie Regulations. The sale veterinarian will prepare stan-
dard, interstate health papers for transportation between states, but it is the
buyer’s responsibility to be cognizant of and adhere to the entrance
requirements of his own state. When entry permits are required, this can
often be done prior to your arrival at the sale by contacting your state office.
Your local veterinarian can often help facilitate this process.
buyer nuMber:
Buyer numbers will be used. A buyer number is
valid for all sales and in all barns. A valid picture ID is required to be pre-
se
nted at buyer number sign up. Buyer numbers must be issued in the
exact way that registration papers are to be transferred. If you register ani-
mals in different names, you will be required to get a number for each name
used. A complete name, mailing address and telephone number are
req
uired for all buyers to receive a number. This same information is need-
ed by the veterinarians to write complete health papers.
Mail bids:
If you cannot attend the sale in person, a number of indi-
viduals will be able to handle your bids. These include the Sale Manager,
Greg Deakin, the auctioneers, ringmen and judges. All mail bids must have
pre-approval by Sale Management prior to the start of the sale. All mail bid
animals must be paid for within 5 days or assessed a 5% fee. The above
Buyer Premium applies to all mail bids. Banner Sale Management advises
that you contact us well in advance of the sale if you are considering using
a mail bid at this sale.
terMs and conditions
terMs:
Cash, check or credit card payment on Sale Day. A 4% con-
venience fee will be charged for credit card payment. All purchases are to
be settled with the clerks immediately following the sale and before the
sheep are removed from the premises unless arrangements and approval
have been made with the Sale Manager prior to the sale. The auctioneer’s
decision is final on any disputed bids. All animals are at purchaser’s risk
as soon as sold. A 20% surcharge will be assessed to any insufficient
funds check issued. Buyer shall be responsible for any and all costs of col-
lection, including attorney’s fees. Institutions may pay by requisition.
Foreign buyers must pay in U.S. funds. Registration papers will not be
transferred to the new owner until paid in full.
sale guarantee
except for those stated in the below guarantee, there are no war-
ranties, either expressed or implied, as to the merchantability of fit-
ness for a particular purpose with respect to the sheep being sold in
this sale.
the warranties and guarantees set forth in the below guarantee
are in lieu of all other warranties, either expressed of implied, and the
remedies provided therein shall be the sole and exclusive remedy of
the buyer, or any party claiming through the buyer, for any breach of
warranty or guarantee therein provide, and all obligation or liabilities.
1 – every ram and ewe sold will be guaranteed as a breeder if
properly handled. it shall be the responsibility of the buyer to return
the non-breeder to the seller in acceptable breeding condition. the
seller, after a fair trial, and the animal is found to be a non-breeder,
shall have the privilege of replacing the ram or ewe with one of equal
value to the satisfaction of the seller, or refunding the purchase
price. this guarantee shall not apply the first year to any sheep that
are shown subsequent to the date of the sale. all ewe lambs are
exempt from the breeding guarantee the first year.
2 – notification of non-breeder rams must be made to the seller
prior to october 1st following the sale; notification of non-breeder
ewes must be made to the seller prior to april 1st the following year.
3 – any lambs who drop their lamb’s teeth prior to 12 months of
age as determined by their registration paper, shall be replaced with
a lamb of equal quality to the satisfaction of the buyer within a rea-
sonable amount of time, or the consignor shall refund the purchase
price of the lamb promptly with all feeds and percentages levied
against such a lamb retained by the sale. it shall be the responsibli-
ty of the buyer to notify the consignor, and then the sale manager, if
such a problem occurs. any consignor failing to comply by this rule
shall automatically be barred from consigning any sheep in the fol-
lowing sale.
4 – in the event any ewe represented as being open lambs within
140 days from date of sale, seller agrees to refund the buyer the full
purchase price, or buying credit, or replacement ewe, upon delivery
of the ewe and lamb(s) back to the seller.
5 – this guarantee shall constitute a contract between the buyer
and the seller only, and no other parties assume any liability, legal or
otherwise, expressed or implied.
6 – neither the sale Managers nor sponsoring organizations can
or will assume any responsibility as to the authenticity of the pedi-
grees, bloodlines, or information provided in the sale catalog, pen
cards or otherwise, and the subsequent genetic performance of any
sheep purchased. all such information must be accepted at face
value. any statements or information given sale day supersedes cat-
aloged information. any special guarantees or claims offered by
individual consignors is strictly between the consignor and the
buyer, and will not be enforced by the sale Managers or the spon-
soring organization.
Paying for online Purchases:
Visa, MasterCard, American Express or
Discover will be the only accepted methods of payment for any purchases made
through the DV Auction broadcast online unless other arrangements are made with
the Sale Management prior to the Sale. All credit card purchases will have a 4% fee
added to the purchase price. The above Buyer Premium applies to all online bidding.
All monetary funding will be in U.S. currency. The right of the property shall not pass
until settlement is made. All settlements must be made before any sheep will be
released. Transportation arrangements are the responsibility of the buyer. Any ques-
